By accessing, using, or purchasing services from Andres Marketing (“Company,” “we,” “us,” or “our”), you (“Client,” “you”) agree to the following Terms & Conditions. If you do not agree, please do not use our services.

1. Services

Andres Marketing provides digital marketing services which may include, but are not limited to:

Website design and development

Social media marketing

Content creation

Branding and strategy

Advertising management

Consulting and marketing education

Specific services, deliverables, timelines, and pricing will be outlined in a separate agreement, invoice, or written communication.

2. No Guaranteed Results

While Andres Marketing uses proven strategies and best practices, we do not guarantee specific results, including but not limited to revenue, leads, sales, engagement, or rankings. Marketing outcomes depend on many factors outside our control.

3. Client Responsibilities

You agree to:

Provide accurate and complete information

Respond in a timely manner to requests for content, approvals, or feedback

Own or have permission to use all content, logos, images, and materials provided to us

Delays caused by the Client may affect timelines and results.

4. Payments & Fees

All fees are due as outlined in your invoice or agreement

Payments are non-refundable unless explicitly stated otherwise in writing

Late or missed payments may result in paused or terminated services

Andres Marketing reserves the right to update pricing at any time with notice.

5. Intellectual Property

All original materials created by Andres Marketing remain our intellectual property until full payment is received

Upon full payment, the Client receives a license to use the agreed deliverables for their business

You may not resell, reproduce, distribute, or claim Andres Marketing’s work as your own

Andres Marketing retains the right to display work for portfolio and promotional purposes unless otherwise agreed.

6. Brand Protection & Misuse

You may not:

Misrepresent Andres Marketing or its services

Use our name, logo, or content in a misleading or defamatory manner

Claim partnerships, endorsements, or guarantees that do not exist

Any misuse of the Andres Marketing brand may result in legal action.

7. Confidentiality

Both parties agree to keep confidential any non-public business information shared during the course of the engagement, unless required by law.

8. Termination

Andres Marketing reserves the right to terminate services at any time if:

Terms are violated

Payments are not made

Communication becomes abusive or unprofessional

The Client may also terminate services, but no refunds will be issued for work already completed or time reserved.

9. Limitation of Liability

Andres Marketing shall not be liable for:

Indirect or consequential damages

Loss of profits, data, or business opportunities

Platform changes, algorithm updates, or third-party issues

Our total liability will not exceed the amount paid by the Client for services.

10. Third-Party Platforms

We are not responsible for issues caused by third-party platforms including (but not limited to) Google, Meta, TikTok, hosting providers, or payment processors.

11. Governing Law

These Terms & Conditions are governed by the laws of the State of Texas, without regard to conflict of law principles.

12. Updates to Terms

Andres Marketing reserves the right to update these Terms & Conditions at any time. Continued use of our services constitutes acceptance of the updated terms.
